I see on ebay a repo photo of the famous boxing ned photo is now up for sale...i wonder if permission was asked to reproduce it from the current owners?????

Hi Paul, I think you will find that this copy was made long before the current owners bought the original.
It is an interesting thought because think of all the places that image has appeared before it was re-sold.
I have clippings of it when it was missing and when it was sold previous to its last sale. All the copies of those copies (if you follow me here.lol) could not have copyright applied because they were before the current owner bought it. I am not a lawyer, however common sense would surely dictate one could not stop the reproduction of a photo that was created prior to its sale.
Apart from the above, it would be impossible to stop someone selling such a copy on e-bay anyway.
Have you ever tried to stop someone in breach of copyright? It is near impossible due to the costs of litigation. I used to do it at work and very few were willing to do more than bluff due to the high costs of taking it to court. Also, try stopping someone selling an item on e-bay, such as that fake wanted poster, it is impossible and e-bay will not help, in fact they will take you on if you interfere!
Anyway, that is my 2 cents worth. (which is probably all it's worth)

That same seller has the reproduction of the famous "Joe on the door" photo for sale at their website, too! Wonder who owns "rights" to that? EDITED to say that Dave posted at the same time I did, LOL, and answered about how they can legally "get away" with this practice!

Funny that ebay pop's up again when it comes to " Ned " items, I think we had a similar discussion on another thread. Sure there is some rare bits & pieces that appear from time to time but how easy is it to print any picture from a number of books and flog them off as " collectable ", " rare" or hard to find ! The big wheel turns........

Hi again everybody,

I checked out that version of the 'boxing Ned' pic yesterday. The seller is claiming that the copies they are selling have been copied straight from the original - not true!

Interestingly, that original has only been copied three times. It was copied by Ian Jones after he discovered it in 1962. Ian's 'copy' has been the one that has subsequently been published squillions of times over the last 42 years. Of course, the copy negative made in 1962 is the best version we have of the photograph, because it has faded since 1962. On a nice clear version of the photo, you can even make out Ned's lazy left eye.

The only other times the original was copied directly, to my knowledge, was last year during 'The Legend Of Ned Kelly', and for the auction catalogue just prior to its most recent sale.

A quick look at the ebay post proves that the copy currently for sale hasn't been taken from the original.

As for copyright, who really knows?

PS - it's amazing how much detail you can get from original photos. A first generation print under a magnifying glass really tells a story - hey Tim?!!

Hi Matt, what about the guy who owned the picture and had it in his safe in Hong Kong? He could have had it copied?
Are you familiar with what happened after it was reported to have gone missing?
I have an article somewhere from Aussie post all about it and several others about it being sold way back and obviously again more recently.
I agree with you that the E-bay one would not have been from an original.
As a matter of interest he has had one up for sale many times but I could not tell you if he gets many bites as such.
